By downloading, storing or using any material from this site it is implied that You, the user, are accepting ALL the following terms & conditions and agree to be bound by such terms and conditions. If You disagree with anything stated hereunder please discontinue Your use of this site and erase all data You may have already downloaded-

  1. The Malta Tourism Authority (“MTA”) and its licensors, including the creator of the image, own all copyright and other intellectual property rights over the images and material contained on this site.
  2. The images or material on this site shall only be used for the purpose of promoting Malta as a visitor destination and such images shall be used in accordance with these terms and conditions. Such uses include;
    a. Illustrating articles about Malta in newspapers and magazines;
    b. Illustrating guide books, travel publications, maps, etc…
    c. Brochures of tour operators airlines and other travel service providers;
    d. Websites and other online media featuring Malta;
    e. Digital media (such as mobile apps, games, etc…);
    f. Presentations, public lectures, slide-shows, etc…
    g. Television programmes
    h. Adverts promoting Malta;
    If your intended use is not listed, please contact the MTA for advice prior to making any use of such images.
  3. Unauthorised use of the images and/or material contained in this site constitutes copyright infringement and shall entitle the MTA and/or its contributors to exercise all rights and remedies under applicable intellectual property rights laws, including but not limited to any monetary damages against all users and beneficiaries of the use of such images.
  4. All users who make use of any images contained on this site, shall through that use by accepting any and all liability arising from such use, and agree to indemnify the MTA and its licensors for any claim, inclusive of costs, expenses and damages, arising out of or related to the user’s use of the said images (whether alone or on conjunction with any other material) or any breach of these terms and conditions.
  5. The MTA shall not be liable for loss of access to images, due to technical faults, force majeure and/or other circumstances.
  6. The MTA shall not be liable for any inaccurate image and/or other material information supplied by third parties.
  7.  Users may only download and store images they plan to use as materials for the creation of a project, website or publication. No images shall be archived, other than those images which are going to be used in relation to such projects, websites or publications. The downloading or archiving of the entire collection or a substantial part of it is prohibited.
  8. The images on this site are provided to the user as is. No images or collection of images shall be redistributed in any way or designed for reuse. The images contained in this site shall not be sold, offered to be sold or sub-licensed without the MTA’s express consent.
  9. A link (or textural credit in non-web applications) to this site is required where an image is used. Acceptable credits include 'image: www.viewingmalta.com' or a hyperlink to the URL 'http://www.viewingmalta.com'. The credit shall be located in a suitably readable font on the same page as the image, and shall state the name of the copyright holder and the MTA.
  10. When images are used in printed material or non internet-connected electronic media, a credit is needed on each page (or a facing page) where an image is used. The credit can either be at the bottom of the page or near the image i.e. in a caption. Many designers find the credit is less intrusive when it is printed sideways or at the edge of the page near the gutter.
  11. Images may also be used in other forms of digital and video media (games, demos, presentations, interactive systems, films etc.) where a credit is required either where the image is used, or at the start of the presentation/film or on a 'welcome screen'.
  12. Where images are used in online banners the credit link may be included on the page where the user who clicks the banner is taken to. This page will be the final destination page of the banner link. Please contact us if you would like to use the images without a credit.
  13. The MTA reserves the right to change these terms and conditions at any time without further notice. Changes will be published on the www.viewingmalta.com website, and it shall be the user’s responsibility to take note of any such changes. The use of this site will be subject to the most current version of the terms and conditions published on the site at the time when the user/s make use of this site. Users are free to edit or modify the images in any way they deem fit, provided that users shall not crop more than 10% (ten per cent) of the total image content. Furthermore, in the case of use of images featuring (a) trade names, trademarks, or service marks owned by a third party, or (b) a likeness of, or reference to an individual, users are responsible to ensure that these are used in accordance with trademark and copyright law, and relevant Data Protection & Privacy laws, where these are applicable.
  14. Some of the images featured on this site contain trademarks, designs and logos from other entities to which the MTA is in no way connected. All trademarks, designs and logos remain the property of their respective owners and users wishing to use these images should seek permission from the relevant intellectual property rights holder before use. Users are solely responsible for determining whether the use of any image would require the consent of any third party or the licence of any additional rights. Users should not rely solely on the information provided on this site and are advised to seek professional help if they are unsure as to whether additional third-party rights are required for such use.
  15. Maps downloaded from the www.viewingmalta.com website cannot be altered in any way nor reproduced for commercial purposes due to restrictions on third party rights.
  16. All users warrant that they shall not at any time take any step or make any omission that brings the reputation or good standing of the author of the image, the MTA, or Malta and its people into disrepute.
  17. Any images and/or materials which may have been removed from our website, will still subject to these terms and conditions. 
  18. All users who do not make use of the images and/or other material found on this site, in accordance with these terms and conditions, shall have their account terminated.
  19. These terms and conditions shall be governed and construed in accordance with Maltese law and all disputes relating to the performance or interpretation of any term or conditions contained herein shall be subject to the exclusive jurisdiction of the Maltese Courts and Tribunals.

Privacy Policy

 

  1. By registering an account with viewingmalta.com and giving the relevant personal data, the user is deemed to have read these terms and conditions and therefore it is also deemed to have given his/her consent for their personal data to be processed and used by the MTA only.
  2. All personal data processed is processed in accordance with the Data Protection Act, Chapter 440 of the Laws of Malta.
  3. The MTA will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
